To
The Secretary to Government,
Ministry of Overseas Indians,
Government of India,
New Delhi.
Dear Sir,
I am enclosing herewith order of the Delhi
High Court which had envisaged action on
the part of the Government of India, on
the issues involved in the Writ Petition
No. 6149 of 1998.
Unfortunately, that has not been any
tangible action, in spite the direction of
the High Court.
My hopes of getting justice have been
revived with the formulation of new
Ministry. The Ministry has expressed his
concern, compassion and sympathy for NRIs
at the meeting of the World Malayalee
Council held in Kerala House on
26.10.2004.
I am bringing my grievances to the notice
of the Hon'ble Minister also.
I may be permitted to point out that the
speech of Mr. Soli Sorabjee, (former
Attorney General) made in the meeting of
LAW ASIA convened to felicitate him on his
appointment of the Chairman of U.N. Human
Rights Committee, indicates the
possibility of such grievances being
agitated before and considered by the
U.N.Committee. It is submitted that the
Government of India should avoid a
situation in which a citizen of India is
driven to the necessity to appeal to the
UN Body for vindication of his Human
Rights.
I was deprived of the entire savings of my
life when an unjust and illegal action of
the police authority of the Country in
collusion with private interests, in spite
of favourable verdicts from the trial and
appellate courts of that country.
A negation of Human Right is clearly
established when a person is deprived of
his property (exceeding crores of Rupees)
without any justifiable reason whatever
and when the Executive defies the judicial
verdict.
This aspect could be presented by the
representative of the Government of India
before the Government of UAE.
In the alternative, the Government should
expeditiously evolve a method for taking
up the necessary legal proceedings for the
vindication of the just claims of Non
Residents. I m bringing this matter to the
notice of the State of Kerala and other
authorities and Members of Parliament from
the Kerala State.
Yours faithfully,
(P.K.JABIR)
